I get asked constantly by out-of-state investors: “Can I just Airbnb it?” In Las Vegas right now, the honest answer is: it depends heavily on the parcel, and the rules are in more flux than almost any other regulatory question in this market.
Unincorporated Clark County: Effectively Closed to New Entrants
If the property sits in unincorporated Clark County — a huge share of the valley, including many suburban luxury neighborhoods — new short-term rental licenses have been under a moratorium since 2023, with total permits capped at roughly 3,000 countywide. As of this year, that cap remains in place with no confirmed date to lift it. Out of more than 11,000 active listings the county has identified, only around 200 hold an approved permit. In plain terms: if you’re buying with the plan of getting a fresh STR license in unincorporated Clark County, assume you can’t, unless you’re acquiring a property that already carries one.
The Legal Fight Complicates Enforcement
It gets messier. A federal judge issued a preliminary injunction in late 2025 blocking the county from enforcing its licensing and penalty structure while the case is on appeal, even though the underlying 2022 ordinance technically still allows short-term rentals. Separately, the county has moved to require booking platforms to verify a valid license before processing payment for a stay — a rule aimed at unlicensed operators that took effect this year. The net effect is a regulatory environment where the written rules, the court-paused enforcement, and the platform-level restrictions don’t all point the same direction at the same time.
Why This Matters More at the Luxury Tier
Investors chasing STR income on a $2M–$5M property are underwriting a very different risk profile than someone with a $400K condo. If your return model assumes short-term rental income and that income turns out to be unlicensable — or licensable only after years on a waitlist — the investment thesis can fall apart fast. I’ve had buyers walk into an offer assuming Airbnb viability that simply wasn’t there for that parcel.
What I Actually Do With Investor Clients
Before I show an investor a property with an STR plan attached, I confirm jurisdiction first — unincorporated county, City of Las Vegas, Henderson, and North Las Vegas all have different rules, and they don’t move in sync. Then I check whether the specific property already carries a transferable license, since that’s often more valuable than the property’s square footage in this environment. If neither applies, we talk about the investment on its merits as a standard long-term rental, because that’s the scenario you can actually count on today.
